Sections (a) & (b). Annual dues for developed residential lots $175.00 and $30.00 for undeveloped lots. Section (c). No monthly payments. Annual only. Invoiced Jan 1st of each year. Terms: Net 20 days. Changing the dues requires the vote of lot owners. I recommend we use LA RS 9:1141.6, Establishment, amendment or termination of building restrictions. Louisiana RS 9.1141.6.pdf (548.35 KB) 1. Existing building restrictions may be made more onerous or increased by agreement of two-thirds of the lot owners. 2. Existing building restrictions may be made less onerous, reduced, or terminated by agreement of more than one-half of the lot owners. 3. Building restrictions may be established by agreement of three-fourth of the lot owners. Section (e). Currently we charge 5% per cent per annum interest if the dues are not paid by Dec. 31st. I see no need to change. Section (f). Edmond to review as he is a CPA & Attorney. Section (g). Non-payment - Lien and/or small claims court? The problem we have had is serving the owner if we use small claims court, especially those living outside the state. I am open on this matter. Perhaps Edmond can advise. Special Assessments: Voting requirements as stated in LA RS 9:1141.6. Capital Improvements/Expenditures: Ratify that all capital improvements/expenditures must be approved by agreement of more than one-half of the lot owners when the expenditures (1) exceed $30,000 on the repair or replacement of existing equipment or (2) exceed $25,000 on the purchase and installation of new equipment.

I agree with annual dues at $175 and $30. Agree with changing it to annual. Dues can be decreased by BOD but can only be increased by majority vote of the residents. Special assessments require majority vote. Agree to update section 16 using TEIA. Sections e, f and g can remain the same.
